Dispute Resolution; Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this website, these Terms, or your use of the site, including the collection of information through the site, will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will be administered by a recognized arbitration provider under its applicable consumer arbitration rules, and will take place in Santa Barbara County, California, unless the parties agree otherwise.

Class action waiver.

You and Sherry & Associates agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Jury trial waiver.

To the extent any dispute proceeds in court rather than arbitration, you and Sherry & Associates each waive any right to a trial by jury.

If any portion of this Dispute Resolution section is found to be unenforceable, the remainder will continue to apply, except that if the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the website after any change indicates your acceptance of the updated Terms.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sherry & Associates regarding your use of this website.
